Article 1 — Purpose

These general terms and conditions of sale govern all sales between swyo.eu (5 chemin de Daru, 26100 Romans-sur-Isère, France) and any consumer or professional buyer.

Article 2 — Products

swyo.eu sells used physical video games in very good condition for PlayStation, Nintendo Switch, and Xbox consoles. All prices are shown in euros including VAT.

Article 3 — Orders

Placing an order implies acceptance of these terms. The order is confirmed upon payment. A confirmation email is sent to the buyer.

Article 4 — Prices and payment

Prices are in euros including VAT. Payment is made online by credit or debit card (CB, Visa, Mastercard) via a secure SSL server.

Article 5 — Delivery

Delivery is by tracked parcel via Delivengo (La Poste Group). Dispatch within 24 business hours, then 2 business days depending on the destination country. Shipping costs are €5.00 regardless of destination within the euro zone.

Article 6 — Right of withdrawal

In accordance with European Directive 2011/83/EU, you have 14 days from receipt of your order to exercise your right of withdrawal, without giving any reason. This right does not apply to video games whose seal has been broken after delivery.

To exercise this right, contact us at: pro@swyo.eu. In the event of valid withdrawal, we will refund the product price and initial delivery costs within 14 days. Return shipping costs are borne by the customer, except in the case of a defective or non-conforming product.

Article 7 — Legal warranties

In accordance with Directive 2019/771/EU, used products sold on swyo.eu carry a legal guarantee of conformity of 1 year from delivery. All products also benefit from the legal guarantee against hidden defects.

Article 9 — Mediation and dispute resolution

swyo.eu adheres to the mediation service CM2C — 14 rue Saint Jean, 75017 Paris — www.cm2c.net.

In accordance with Regulation (EU) No 524/2013, you may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Article 10 — Disputes

In the event of a dispute, an amicable solution will be sought first. Consumers residing in another EU member state may bring proceedings before the courts of their country of residence. For disputes between professionals, the courts of Romans-sur-Isère (France) shall have jurisdiction.
